These Terms of Use (“Terms”) govern your access to and interaction with our website (the “Website”), including all features, functionalities, and services offered through it. By accessing, browsing, or using the Website in any manner, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must immediately cease using the Website.

These Terms apply to all aspects of your engagement with the Website, including but not limited to:

  1. Viewing property and room listings
  2. Checking availability and pricing
  3. Making reservations and processing payments
  4. Accessing content, media, and related information

In addition to these Terms, your use of the Website is subject to:

  1. Our Privacy Policy, which explains how we collect, use, and safeguard your personal data

If you make a booking through the Website, our Booking Terms & Conditions will govern that reservation in full.

  • “Company” / “Stay By Latinem” refers to Stay By Latinem LLC, incorporated in the United Arab Emirates, including its affiliates and/or service operators.
  • “User”, “You”, “Your” refers to any individual or entity accessing or using the Website.
  • PMS refers to the Property Management System used by Stay By Latinem LLC to manage rooms inventory, pricing, availability, and reservations.
  • CMS refers to the Content Management System used to publish images, descriptions, videos, content, and property information on the Website.
  • “Booking” refers to any room reservation, stay order, or transaction initiated through the Website.

2. Acceptance of Terms

By accessing the Website, browsing room availability, making bookings, or otherwise using any part of the site, you acknowledge that you:

  • have read and understood these Terms,
  • agree to be legally bound by them,
  • are at least 18 years old or are using the Website under the supervision of a legal guardian.

If you do not meet these requirements or do not agree with any part of these Terms, you are advised not to use the Website or submit any personal information, booking details, or payments. Your continued use of the Website constitutes your explicit acceptance of these Terms of Use and any future modifications, and confirms your understanding of your rights, obligations, and responsibilities under these Terms.

3. Changes to the Terms

Stay By Latinem may modify, update, or replace these Terms at its sole discretion at any time. All changes are effective immediately once posted on the Website and the relevant date of change would reflect in the last updated section of the website.

Your continued use of the Website constitutes acceptance of the revised Terms.

4. Purpose of the Website

The Website is designed to:

  • Display room, and property information
  • Showcase content published through the CMS (images, videos, amenities, descriptions)
  • Retrieve live room availability, rates, and inventory from the PMS
  • Allow users to book or cancel stays, manage reservations, and make online payments
  • Provide customer support and general service information

Stay By Latinem does not guarantee the absolute accuracy of PMS-provided data (rates, availability) due to system or network delays.

5. User Obligations

5.1 Accuracy of Information

You are solely responsible for ensuring that all information provided account creation, booking or any interaction with the Website is true, accurate, and up to date. Stay By Latinem reserves the right to suspend, modify, or cancel your account or reservations if any information provided is found to be false, misleading, incomplete, or fraudulent. You acknowledge that providing inaccurate information may result in denial of services, cancellation of bookings, or the application of penalties in accordance with our Terms of Use and applicable laws. It is your responsibility to promptly update any changes to your information to ensure uninterrupted access to services and accurate processing of bookings.

5.2 Booking Confirmation

You agree that:

  • All reservations made through the Website are subject to availability and confirmation
  • PMS-generated booking confirmations, cancellation policies, and payment rules apply
  • All communication will be sent to the email address or phone number you provided

5.3 Guests Below Legal Age

  • Users below 18 years of age may browse the Website but cannot make bookings without the involvement of a parent or legal guardian. Stay By Latinem does not knowingly collect personal information from minors without parental consent. Any bookings or transactions made by a minor without proper authorization may be declared null and void, and Stay By Latinem reserves the right to cancel such bookings, refund payments if applicable, and restrict access to the Website. Parents or legal guardians are responsible for supervising the minor’s use of the Website and ensuring that all information provided is accurate, complete, and authorized.

5.4 User Duties and Responsibilities

  • You may be asked for personal information, such as identification numbers, contact information, or other pertinent information, in order to access specific sections of the website or resources. 7. Booking, Payments & Cancellations

7.1 Room Rates & Availability

All room availability, pricing, and restrictions (such as, but not limited to, minimum stay requirements, deposit rules, cancellation policies) come directly from our PMS and are subject to real-time updates. Stay By Latinem makes every reasonable effort to ensure that the information displayed on the Website is accurate; however, we do not guarantee that all information is free from errors or omissions. Room rates may vary based on factors such as demand, seasonal adjustments, special promotions, or package offerings. Stay By Latinem reserves the right to modify room availability, rates, and restrictions at any time without priornotice. You acknowledge that the final confirmation of availability and pricing occurs only at the time of booking, as reflected in your booking confirmation.

7.2 Payment Terms

By submitting payment information, you authorize Stay By Latinem and its payment processors to charge your selected payment method for all applicable charges, including room rates, taxes, fees, and any additional services. Payment is considered complete only when funds are cleared. You acknowledge and agree that Stay By Latinem may pre- authorize your payment method or place a hold on funds to guarantee your reservation. Any declined, expired, or otherwise invalid payment method may result in the cancellation of your booking. Stay By Latinem reserves the right to refuse or cancel any booking where payment is not successfully processed or where fraudulent or unauthorized payment activity is suspected. We accept payments online using Visa and MasterCard credit/debit cards in AED.

7.3 Cancellations / No-Shows

All cancellations, modifications, and no-show penalties are governed strictly by the cancellation policy displayed at the time of booking. Guests are responsible for reviewing and complying with the applicable cancellation terms before confirming a reservation. Any requests for modifications or cancellations must be submitted in accordance with the procedure outlined in the booking confirmation. Stay By Latinem reserves the right to charge applicable fees, including partial or full booking amounts, for late cancellations, no-shows, or changes made outside the permitted timeframe. The exact amount of any penalty will be calculated based on the specific terms of the booking and may vary depending on room type, rate, and promotional offers.

7.4 Fraudulent Payments

Stay By Latinem reserves the right, at its sole discretion, to cancel or refuse any reservation where fraudulent, unauthorized, or suspicious payment activity is detected. This includes, but is not limited to, the use of stolen, expired, or invalid payment methods, suspicious account behavior, or violations of our Terms of Use. Guests are liable for any losses, damages, or costs incurred as a result of fraudulent activity associated with their booking. Stay By Latinem may also report suspected fraud to relevant authorities, cooperate with investigations, and take any necessary legal action to protect its business, customers, and payment partners.

8. Content & Intellectual Property

All content available on the Website, including but not limited to room images, property photos, facility descriptions, videos, logos, branding, text, graphics, and other materials, is the property of Stay By Latinem or is used under license. All such content is protected by copyright, trademark, and other intellectual property laws.

You agree that you must not:

  • Copy, reproduce, modify, adapt, display, distribute, or otherwise exploit any content from the Website without our prior written consent;
  • Scrape, extract, or otherwise access room inventory, pricing, or booking data for commercial purposes;
  • Republish, sell, or use any content from the Website for any commercial or unauthorized purpose.

All names, logos, designs, and branding elements displayed on the Website are trademarks of Stay By Latinem or its affiliates. Unauthorized use of any intellectual property, including attempts to reproduce, create derivative works, or otherwise infringe upon our rights, is strictly prohibited and may result in civil and/or criminal liability.

By accessing and using the Website, you acknowledge and agree that Stay By Latinem retains all ownership and intellectual property rights in its content, and nothing on the Website should be construed as granting any license or right to use any content except as expressly permitted under these Terms.

9. Third-Party Services

The Website may integrate with and rely upon certain third-party services to provide and enhance our offerings, including, but not limited to:

  • Payment gateways for processing transactions
  • PMS service providers for managing bookings and room availability

Your personal and booking-related information may be shared with these third-party service providers strictly to facilitate the provision of their respective services. Stay By Latinem does not control and is not responsible for the privacy practices, data security measures, or content of these third-party providers. Each third-party provider operates under its own Terms of Use and Privacy Policy, which you should review carefully. By using the Website and accessing third-party services, you acknowledge and agree that your information may be subject to the policies and terms of those third-party providers.

Stay By Latinem shall not be liable for any errors, delays, interruptions, or damages arising from the use of third-party services or from any actions taken by third-party providers.

  • Payment Processing

Stay By Latinem LLC uses third-party payment gateway services provided by accredited banking partners. By completing a reservation or making any payment on the Website, you authorize these payment processors to securely process your payment information. The Company does not store or retain credit card details, and all transactions are encrypted in compliance with industry security standards (PCI-DSS or equivalent) from the bank’s payment gateway providers.

  • Payment Authorization

By submitting payment information:

  • You confirm that the payment method belongs to you or that you are authorized to use it.
  • You authorize the payment gateway and Stay By Latinem to charge the full amount indicated at the time of booking.
  • You acknowledge that the booking will only be confirmed upon successful payment authorization.
  • Failed or Declined Payments

A booking may be automatically cancelled if the payment gateway declines the transaction for any reason, including insufficient funds, incorrect details, fraud prevention checks, or gateway errors. Stay By Latinem is not responsible for losses arising from failed or declined payments.

  • Cancellations

Cancellation policies displayed during the booking process apply strictly to your reservation. These policies may vary based on room type, season, promotional rates or minimum-stay requirements. It is the user’s responsibility to review the applicable cancellation policy prior to confirming a booking.

  • Refunds

Where refunds are permitted based on the cancellation policy stated at the time of booking:

  • Refunds will be processed to the original mode of payment only.
  • Processing times may vary based on the payment gateway or issuing bank (typically 7–21 business days).
  • Stay By Latinem is not liable for delays caused by banking partners, intermediary financial networks, or international clearing systems.
  • Non-refundable bookings are strictly non-refundable under all circumstances unless required by applicable law.
  • Partial Refunds or Adjustments

In cases of booking modifications, early check-outs, or service disputes, any approved partial refund or rate adjustment will be processed according to the original payment method and subject to the same timelines and gateway procedures.

  • Chargebacks & Disputes

Initiating a chargeback without first contacting Stay By Latinem to resolve a payment concern may result in:

  • immediate cancellation of the reservation,
  • denial of future booking privileges, and
  • legal or collection actions where necessary.

The Company reserves the right to provide supporting documents to the bank to contest any unjustified chargebacks.

  • Currency & Additional Charges

All transactions will be processed in the currency specified on the Website at the time of booking. Any additional fees (including international transaction fees, bank handling charges, or currency conversion fees) imposed by your bank or card issuer are your responsibility

10. Privacy and Data Protection

Stay By Latinem processes your personal data in accordance with applicable data protection laws and its Privacy Policy.

Data collected may include:

  • Personal identification
  • Booking history
  • Payment details
  • Device & usage information

We implement reasonable safeguards to protect your data but cannot guarantee 100% security due to the nature of the internet.

11. Prohibited Use

You may NOT use the Website to:

  • Violate any laws or regulations
  • Attempt to damage, disable, or compromise the Website
  • Upload malware, scripts, or malicious content
  • Scrape or extract pricing, availability, or CMS content
  • Conduct fraudulent bookings or chargebacks
  • Use bots, spiders, or automated tools to access or copy Website content

Any violation may result in blocked access and legal action.

(Website) will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of the UAE.

12. No Warranty

The Website is provided “as is” and “as available” , without any warranties:

  • No guarantee of uninterrupted access
  • No guarantee that content is error-free or always up to date

Stay By Latinem is not responsible for:

  • Network outages
  • Third-party service failures
  • Inaccuracies caused by PMS sync delays

13. Limitation of Liability

To the fullest extent permitted by law, Stay By Latinem shall not be liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount paid by you for the booking in question. Stay By Latinem, its affiliates, employees, or service providers shall not be liable for:

  • Loss of profits or business
  • Service outages
  • Booking errors caused by user negligence
  • Computer viruses or harmful components
  • Damages resulting from use or inability to use the Website

Our maximum liability is limited to the amount paid by you for a booking.

14. Links to Third-Party Websites

The Website may contain links to external websites or resources that are provided solely for your convenience and informational purposes. Stay By Latinem does not control, endorse, or guarantee the content, products, services, or practices of any third-party websites, and the inclusion of such links does not constitute an endorsement by Stay By Latinem.

You acknowledge and agree that Stay By Latinem is not responsible or liable for:

  • The accuracy, completeness, or reliability of any content, advertisements, or materials on third-party sites;
  • The security, privacy practices, or data protection measures employed by third-party sites;

15. Governing Law & Jurisdiction

These Terms are governed by the laws applicable in the United Arab Emirates.

Any dispute arising from or related to these Terms shall be settled exclusively in the competent courts of the designated state.

16. Force Majeure

We are not liable for delays or failures caused by events beyond our control, including natural disasters, government actions, war, terrorism, labor disputes, internet outages, or system failures.

17. Termination

We reserve the right to suspend or terminate your access immediately, without notice, for any breach of these Terms or activity that may harm our reputation or operations.

18. Severability

If any part of these Terms is deemed illegal or unenforceable, the remainder shall continue in full force and effect.

19. Entire Agreement

These Terms of Use constitute the entire agreement between you and Stay By Latinem LLC regarding your use of the Website.
